Hi,
I am on H1B visa for the past 2.5 years and my current visa expires on 30th Sept 2010. When i approached my company for visa extension, i was told that based on management decision they are changing my visa from H1 to L1. I have a question on this one. If i proceed with this process and in the mean time i get a job offer from different company in US that is ready for H1 transfer and extension, Is it valid? Can i continue to work on my H1 for remaining years? If this is not a valid case and i need to continue with L1 only (with current employer), Will my number of years to work in US be reduced?
Please treat these questions as urgent ones and kindly reply.

How can you pan to live long term without being a resident is something I don't understand..
I am assuming that by this you mean "long term plans without having a GC". While it might be difficult to imagine setting roots in this country without a GC, it also means that for some reason you think that the GC will be denied and so you don't want to set roots in this country.
If you don't think your GC will be denied, I don't see any problem in making long term plans and setting roots here while waiting for the GC. It is going to happen - it is just a matter of time.

Immigration-law has reported that AILA has stopped taking any more plaintiffs for the lawsuit. What's IV stance on that? Does that mean if the lawsuit is settled in favor, only plaintiffs will get the benefit?

forget sulekha..i posted our ad couple of times ,after that they started to delete.I am not sure what the reason is...
All i need is the forums which have more members with more activity.I will spend sometime to join them and post.
It is sad that none of these desi sites have come forward to help us put our ads on their sites. None has helped us in our cause, even though they are run by immigrants like us who were at one time waiting in line for their greencards. Now after getting their greencard they do not want to help the cause but instead want to make money from it. If any such site owner is reading this post and desires to help by posting our ad on your site, contact us.

could you do a search on yahoo groups, msn groups, google groups on greencard, immigration, legal immigration etc and see if those groups have many members and it is not an anti immigrant group from its intro. Then join them and start posting IV messages in them. You will find hundreds of groups. Each post will send emails to all its members.

There are several groups in yahoo, msn, google that belong to alumni of IITs, IIMs etc and a lot of their members are in USA. you can post messages in those forums too.

YOU PEOPLE understand first what i kept in the reply. I did not blame IV for doing other efforts..I am talking about facts about USCIS..So dont make fool us or yourself as IV or any other organization will not be able to attack USCIS..Bcoz USCIS is monarch..

Its kind of a funny situation, and dangerous at the same time. This is a setup for a perfect storm and these idiot "friends" are planning for sunny days ahead. I guess someone forgot to turn on the weather channel, which in this situation is equivalent to "using common sense".
I am sorry to say this but all these "friends" are actually not your friends. Its better to have a wise foe than foolish friends.
Intelligence is about matching the dots and foresee the coming events, which always tend to cast their shadow before they appear. Idiots tend to overlook the dots, and they continue to live in fools paradise. The problem is not the formation of a perfect storm, the problem is most of these "friends" will be caught off-guard, and the ship will take everyone down with them. I wish I knew of a better way to desrcibe the current situation.

Economy and job losses - this economy will not spare anyone and one has to be ready for ac21 and ex employer revocation and uscis officer sending denial and filing mtr than celebrating based on thoughts that Obama will give a green card.
Someone suggests - ahh I got EAD so I will get Green card soon, someone suggests I got finger print so I will get Green card soon.
I have seen people saying "My employer loves me and will never fire me - he invited me to play golf with him yesterday".
For those who keep saying "I will go back to my home country" - just look at the other side of the window - there are tons who want to jump this side.

Sir, you are a senior and active IV member and i respect that totally.
but EB3-I dates are rolling on nicely, they are already oct 01 they will cross well in 2002.
in june 07, they were at june 03. then this mess happened in july and eb3-i was almost frozen over the entire year. now its starting to thaw..
you must have already written to congressmen and called them up, also communicated with ombudsmen, i would say, please just wait and watch.
i'm not eb3 but eb2 but i'd say allow older eb3 to get out of this rut.

Just need to counter the issue - one of the proposal was to do a flower campaign. I am not sure you were on forum when we did last time. It was a huge success. I am requesting to do it one more time!

Yes, they can do a lot more than 25 k in 2 months.
EB2 folks, please get prepared for RFEs - a few possibilities.
1. Medicals, outdated physicals, PPD positive etc.
2. Passport expired since applying for I-485 last summer.
3. Father's or Mother's name misspelled.
4. DOB discrepancies.
5. Translations of documents
6. Find those old pay-stubs, bank records, W2s, I-20s
7. Google yourself and your spouse.

Friends I think we should stop digging till the last quarter. I believe finally then all the optimism, hopes and dreams will come true. Best of luck to all, since we have all waited for so long 3 months are not so far, I feel many of us have burnt ourselves waiting and speculating this bulletin. The disappointment is really understandable. Many in the group are looking to just file 485 to get EAD/AP; I don't know when our day will come.

USCIS did not say that they will return the application and they should be refilled.
With their announcement on July 17th, they have about 16 more days in this month left. It is a heavy workload for them to reject all the petitions (minimum 200K packages) which is unnecessary work and cost enourmous amount of money.
Also they will not invite another problem if the do not give sufficient time to the clients to file, what if someone receives the package Auguest 15. That will be another mess up.
It looks like SCs have rejected some applications on the same day (July 2nd), those applicants should have already received them(on July 3rd or 4th). They have to refile. Rejections after July 17th may not be true.
My lawer says:
Your application has reached INS on July 2nd and upon the statement from USIC on July 17th, it will be accepted.

I have seen the similar stop points in San Diego also and also while travelling to CA from AZ I was stopped at the border and then the office looked inside the car and said and thank you and let us go. I normally drive CA on the long weekends most of the time and everytime the same thing happens.

I could see myself or any other desi dude and I have seen people in this situation. Its painful. Myself, I learnt my lesson during the 2000 - 2002 recession and spent all these years preparing for something like this. It was a difficult but I had to do it. I kind of knew that this would happen every 10 years. This time it did not take it 10 yrs.
By the way, I liked your narration of the incident. I wish I could do it.
We have very skilled people here and here is my suggestion. Why don't we make a documentary on these stories and the problems we face due to immigration. It will be much better way of putting our concerns before the people and I am sure even the immigration hardliners will sympathize with us if they hear us out and what we are going thru even after being there for 7-10 years paying taxes and doing our due diligence.
These are my 2 cents and good luck with your job slumdog!
