If AOS takes 3-4 years (read long time) USCIS will issue RFE (for EVL) anyway to re-confirm job offer - even if we dont use AC21 and change employer. That is standard procedure. So sending them employer change notification is not going to help us anyway. And if we change job multiple time during this 3-4 years sending them letters everytime may cause more RFE. But it is always better to have EVL with us if we change employer using AC21 and send them when asked.

My lawyer confirmed they were "unable to" include the Employment Verification Letter along with the AOS/ EAD/ AP packet that was submitted in time to reach USCIS on July 2.
What are my options now? If you have any insight please let me know.

1. Send Employment Verification Letter even before Receipt Notice is received for I-485. This is likely to be lost in the mess that it is now, but does not hurt trying!

IV has people on the national advisory board that include the previous USCIS ombudsman, what is their take on this? I have not seen any thoughts from such experts that support this organization on this issue of quarterly spillover

My friend I have seen many things in my 45 years life. But never have I seen as much bullshit in one post. If you are so smart that your invention could lose $3 billion in a quarter, why are you unemployed for last 1 yr? If you don�t have a job it has got to be someone else�s fault, right? This is not a new trend. While you are ok to work in a company started by an immigrant or in a technology created by an immigrant, you find it morally wrong for immigrants to compete with you, right? The visa numbers for Indians in EB2 category is 'unavailable' currently. Every month the USCIS estimates (rather guesses :rolleyes:) the demand for visas in each category adds to it their own forecasted work pace and based on some super secretive formula comes up with a cut-off date....as we all have seen this formula is by no means accurate (knowing how it went from being current for all employment based category in sept 05 to unavailable for eb3 indians at begining of they year to the dates moving 5 years for chinese eb2 in a few months..etc ..etc)
Wouldn't it be nice if USCIS gives themselves a break from the stressful guess work ;) every october and instead of giving cut-off dates, just make eb1-3 'available' for all across the board...then all of us waiting with approved i140's can file 485...get EADs..our wives can work...we can change jobs per will and live happily ever after...May be they can use the data gathered from all the petition received to forecast a better cut-off date for the remaining 11 months...And if they repeat this every year....the most one would have to wait with an approved I40 to file I485 is one year....I am sure lot of guys with pending applications at BECs would also jump on this idea and file new perm petitions...effectively reducing the backlog..if not eliminating it.
Mean while I am proposing all this in humour and not advocating IV to adopt it in their agenda :) ...so don't start pounding on me just yet...

How is it different from companies like TCS, Wipro, Satyam, Polaris etc that do a lot of campus recruiting, provide intensive training and place the candidates on projects and eventually coming here.

I hope some lawyer on this forum or on their respective websites can answer this question I think most folks have given their FP's only once some where from Oct - Dec 2007 time frame and USCIS said they do not need more FP's for most cases since they now have the ability to reuse the FP's. My guess is unless you have a criminal record of some kind or perhaps your name appears in the POI list they do not call you for FP again perhaps some random cases as part of Quality checks might be included but thats it.

GMAT score alone is not the criteria but they are a bit liberal on the online version. Your recommendations matter and your experience, essay and previous education credentials matter too. I am not sure about the cut-off for KD but I started part-time and converted to KD when I moved out of Indiana. My GMAT score was either 620 or 630, which I thought was on the lower end of the curve. I started my M.B.A a year before I got married and found it much easier to manage my time then. But these days my wife keeps complaining that I spend way too much time studying rather then with her. Managing with kids is going to be even more tough but definitely not unmanageable. I have colleagues, in my M.B.A program who are married with 2-3 young kids, who have said that I made the right move by trying to complete my M.B.A before having kids.
My intent is to just let you know that it won't be a cake-walk but then online will allow you lot more flexibility and time than regular or part-time M.B.A. You do not need to worry about attending classes and getting struck in traffic, assuming you could find a good school close by.

I know its not fake..because I have 3 people on our floor who came from a visit..who saw these kind of things happening right in front of them (and my friends were GCs so I guess they themselves were left alone).
first of all cut this BS. citizens and GC holders have different queues at POE and all visa people have different queues.how the hell ur friends heard the officers questions.do they have snake ears or what.use ur common sense.
i came recently on march 20th and how come i did not see when there were 50 desis in the visa's queues.stop these rumours.
i went to sbi when i was in india. that sbi manager came to know this and he was telling about that.i thought it might be a rumour but it still gave me couple of sleepless nights.see how fast this BS is spreading.

Another thing you need to consider is If anycase had a PD before sept 2004 and was filed for I-485 before July 2007. That must have got the approval unless there was a namecheck delay.
EB2 India PD came only up till April 2004 before it retrogressed. There is no way anybody whose PD is between April to Sept 2004 could have applied before July 2007. They might have applied only in July 2007 when USCIS made EB2 PD current by mistake.

All this discussion about revealing sources and gaining fame is really funny from my pov.
AILA liaison reports routinely name this official, news reports also routinely name this official. He has also testified before Congress and those transcripts are freely available to those who look. If you have not heard his name before and do not know he is the one who sets cutoff dates, it is only because you haven't been paying attention in class...:)
Also in this case it was Ron Gotcher reporting on the AILA So Cal Liaison meeting who revealed his name in the first place.
I should also add that I have no special connection with this or any other official (sigh -- wouldn't I have my greencard already if I did). I've done my share of research since I got stuck in retrogression in Oct 2005, and have exercised my rights as a stakeholder in the immigration process to pick up the phone and ask questions where ever I can. Knowing the sections of the INA, the contents of the Ombudsmans Reports, CRS reports etc. tends to make people very responsive.
As for the reason for me sharing this information -- which after all I could have just sat on for myself -- was because I would want the same -- if someone found out something that potentially was going to affect my greencard I would want to know. I want to know every possible shred of information.
Of course maybe that is what I should do the next time. Just sit tight.:D
